1. Definitions

• (1) the App
App which we develop and serve


• (2) Host
External computers of a third party which the App communicates (any computer on network such as server which corporation serves web service etc, mobile device, or personal computer)


• (3) Gateway
Network nodes that the App goes through when communicating to Host (any node visiting when network commucation such as router, switch, or NAT server)


• (4) Device Address
IP address of the device installed the App


• (5) User Contents
Address of Host and Gateway which you registed for communication, and preferences information of the App


• (6) Personal Information
Information that can be used to identify you, which may include your address, name, job, e-mail address, telephone number, your profile image and other information


• (7) Intellectual Property
Statutory and other proprietary rights in respect of copyright and neighboring rights, all rights in relation to inventions (whether patentable or not), patents, plant varieties, registered and unregistered trademarks, registered and unregistered designs, circuit layouts and Confidential Information and other rights arising from intellectual activity in the industrial, scientific, literary or artistic fields


• (8) Intellectual Property Rights
Copyrights, trade secrets, trademarks, patents, inventions, designs, logos and trade dress, moral rights, mask works, rights of personality, publicity, and privacy, rights in customer information, rights (if any) in domain names, and any other intellectual property and proprietary rights

2. Acceptance of the Terms

1. Your use of the App is subject to the terms of the legal agreement between you and us set forth in the Terms.
2. Except as specified herein, the Terms apply to any use of the App.
3. The Terms apply to all users.
4. Please read the Terms carefully before using the App. In order to use the App, you must first agree to the Terms.
5. In any part of the App, you agree to be bound by the Terms since completion time of the consent procedure.
6. You may not use the App if you do not accept the Terms.
7. You must use the App with obtaining the agreement of your parent or legal representative if you are not of legal age to form a binding contract with us.

3. Changes to the Terms

1. We may change the Terms at any time without obtaining your consentration. You shall agree without objections.
2. If we change, we'll let you know the changes of the Terms.
3. If you continue to use the App after the Terms is changed, You are considered agreed those changes without objections.

1. You may not infringe the Intellectual Property Rights of us or a third party.
2. You may not damage honor or credibility of us or a third party, or unfairly discriminate or slander.
3. You may not do anything that could infringe our or a third party's property.
4. You may not cause financial damage for us or third patry.
5. You may not decipher, decompile, disassemble or reverse engineer any of the software included in all or any part of the App.
6. You may not attempt the access or induce including, without limitation, sending a virus, flooding, or spamming by your use of the App.
7. You may not put an excessive overburden on Host (including Gateway) without consent of Host's administrator.
8. You may not probe, scan or test the vulnerability of Host (including Gateway) or breach any security or authentication measures.
9. You may not access in any manner not permitted by Host (including Gateway) or Host's service with using the App.
10. You may not intentionally or unintentionally violate any applicable local, state, national, or international law, or any regulations having the force of law.

6. Disclaimers

1. We may change the specification of the App or terminate the releasing in AppStore, at our sole discretion, at any time and without notice to you. We are not liable that any damage or loss is caused by the changes or the termination.
2. We make no warranty that the App will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
3. We shall not make any warranties (including, but not limited to, fitness for a particular purpose, effectiveness of a function or result, service quality, safety against threats, merchantability, completeness, accuracy, non-infringement of third party rights, and constant provision of the App, etc.), in regard to the provision of the App to you, regardless of whether explicit or implied.
4. Under no circumstances will us be liable, directly or indirectly, to any party for any damage or loss caused or alleged to be caused by or in connection with the use of the App.
5. The App may communicates to the Internet according to your explicit instructions. You must bear all packet communication fees due the usage of the App.
6. User Contents of the App is saved on iCloud. You must bear alll backup usage fees of iCloud.
7. User Contents may be lost due to an updating or a bug of the App. You must use the App with consenting the possibility of the lost of User Contents.
8. We shall not bear responsibility in any case, to the maximum extent permitted by applicable law, for any indirect, special, consequential, derivative or other punitive damage incurred by you in relation to the use of the App (including, but not limited to, physical damage, property damage, lost profits, data loss, loss of opportunity to use, damage to goodwill, and other damage caused by the suspension of business or other similar damage).
9. In regard to disputes, etc., that arise with another user or third party inside or outside of Japan in relation to the use of the App by you, said you shall resolve the same at your/his/her own responsibility and expense, and we shall not bear any responsibility.
10. In the event of causing damage to another user or third party through the use of the App and then we incurring damage as a result of this, you shall compensate us for damage.

7. Non-Assignment

1. Neither this Agreement nor the rights and obligations hereunder may be assigned by you without the prior written consent of us.
2. We shall assign any part of the App to a third party at our discretion. In the case, all rights of the user related to the App shall be transfered to the transferee.

10. Governing Law, Resolution of Disputes

1. The governing law of the Terms shall be the laws of Japan, and the Terms shall be construed in accordance with the laws of Japan.
2. The Tokyo District Court shall be the agreed-upon court of exclusive jurisdiction in the first instance for all disputes between you and us depending on the amount of the complaint.
